Terms of Service

1. Acceptance of Terms

OptiPeak is operated by Optipeak LLC, a South Carolina limited liability company ("OptiPeak", "we", "us", or "our"). By creating an account or using the OptiPeak mobile application or website (the "Service"), you agree to be bound by these Terms of Service and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. These Terms are a legally binding contract between you and Optipeak LLC.

2. Age Requirements

The Service is currently offered to users in the United States. It is distributed through the U.S. app stores and designed for U.S. users; we make no representation that it is appropriate for use in, or directed to, other countries. This does not prevent a U.S. user from continuing to use the Service while temporarily traveling abroad, though some features (such as food and barcode lookup) rely on U.S. data and may not work fully outside the United States.

You must be at least 18 years old to open and hold an account on your own.

• Under 13: The Service is not intended for children under 13. We ask for date of birth at sign-up and block account creation by anyone under 13, and we do not knowingly permit their use or collect their data.
• Ages 13–17: A user in this range may use the Service only with the permission and supervision of a parent or legal guardian. At sign-up the minor must confirm they have that permission and provide a parent or guardian email address, and the parent or guardian accepts these Terms on the minor's behalf and is responsible for supervising their use. AI coaching is switched off for these accounts until the parent or guardian approves it by following a link we email them; they may withdraw that approval at any time using the same link. Food and workout tracking are available in the meantime.
• Weight-loss coaching and minors. Additional limits apply regardless of guardian approval, and they are enforced automatically: for users under 16, the AI will not program a calorie deficit or weight-loss target at any size. For users aged 16 or 17, any calorie target below maintenance is capped well below the level used for adults, and is only available where a parent or guardian has approved coaching as described above.

3. Description of Services

OptiPeak provides food and nutrition logging, workout tracking and program management, AI-powered coaching, and body-measurement and progress tracking. Services are offered on a tiered basis (Free, Pro, and Elite); feature availability depends on your subscription tier. We may add, modify, or remove features at any time.

4. AI and Health Disclaimer

IMPORTANT — PLEASE READ CAREFULLY. AI coaching, nutritional analysis, workout recommendations, and all other AI-generated content are provided for informational and motivational purposes only. They do not constitute medical advice, diagnosis, or treatment. OptiPeak is not a licensed medical provider. Always consult a qualified physician, registered dietitian, or certified fitness professional before changing your diet, exercise, or health regimen — especially if you have a medical condition or injury, or are pregnant. AI-generated estimates may contain errors; do not rely solely on the Service for health decisions.

Assumption of risk. Physical exercise and dietary changes carry inherent risks, including injury and, in rare cases, death. By using the Service you voluntarily assume all such risks. You are solely responsible for exercising within your limits, using proper form, and stopping any activity that causes pain or distress.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for providing accurate information. You may not share your account or use another person's account without permission.

6. Health Data and Consent

The Service collects and processes sensitive personal health and fitness information. By creating an account and providing this information, you expressly consent to our collection, storage, and processing of it — including body weight, measurements, food logs, workout history, progress photos you upload, and the content of your AI coaching conversations — to provide and personalize the Service. You may withdraw consent at any time by deleting your account. See our Privacy Policy for full details.

7. Subscriptions & Billing

• Subscriptions are sold and processed through the Apple App Store or Google Play; entitlements are managed on our behalf by RevenueCat. Payment is charged to your app-store account, not directly to us.
• Paid subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel a subscription in your Apple or Google account settings. Deleting the app does not cancel a subscription.
• Refund eligibility is governed by the applicable platform's policies (Apple or Google).
• Deleting your OptiPeak account does not cancel your subscription and does not entitle you to a refund of the current period. Because billing is handled by Apple or Google rather than by us, we cannot cancel or refund it on your behalf — cancel in your Apple or Google account settings. Deleting partway through a paid period forfeits the remainder of that period.
• Prices and features may change; material changes will be communicated in advance and will not affect your current paid period.

8. Prohibited Uses

You agree not to use the Service for any unlawful purpose, attempt to reverse-engineer or compromise it or its AI systems, redistribute its content without authorization, input false data to manipulate AI outputs for harmful purposes, or use it in any way that could harm yourself or others.

9. Intellectual Property and Your Content

All content, trademarks, logos, and software within the Service are owned by or licensed to Optipeak LLC. You retain ownership of the data and photos you submit and grant us a limited, worldwide, royalty-free license to host and process that content solely to operate and provide the Service to you (for example, analyzing a food photo). We do not sell your content.

10. Termination

You may delete your account at any time from within the App (Profile → Delete Account), or by emailing support@optipeakhq.com. Deletion takes effect immediately and your data is permanently erased after a 30-day grace period, during which signing back in will cancel it. Deleting your account does not cancel a paid subscription — cancel that separately in your Apple or Google account settings. We may suspend or terminate your access if you violate these Terms or misuse the Service. Provisions that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, and dispute resolution — will continue to apply.

11. Limitation of Liability

To the maximum extent permitted by law, Optipeak LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or reliance on its content. Our total liability shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or $100.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any AI-generated content or nutritional estimate is accurate.

13. Indemnification

You agree to indemnify and hold harmless Optipeak LLC and its members, officers, and agents from any claims, liabilities, damages, and expenses arising out of your use of the Service, your violation of these Terms or any law or third-party right, or any injury resulting from your diet or exercise activity.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law principles. Before filing any claim, you agree to attempt informal resolution with us for at least 30 days. Any dispute not resolved informally shall be resolved exclusively in the state or federal courts located in Charleston County, South Carolina, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in the app or by email, and the version number increments with each material update. Continued use after changes take effect constitutes acceptance.
